Justice NW Sambre granted bail to the Aryan khan and two other accused namely Arbaaz Merchant and Munmun Dhamecha in the Drug case.

The order passed by the Bombay high court will be released tomorrow consisting of the detailed order and conditions of bail.

Senior Advocate Mukul Rohatgi arguing on behalf of Aryan khan, Senior advocate Amit Desai arguing on behalf of Arbaaz Merchant, Advocate Ali khashiff khan Deshmukh arguing on behalf of Munmun Dhamecha and ASG arguing on behalf of Narcotics Control Bureau.

They were arrested on October 3 during the raid by NCB on an international cruise. On October 20 the special NDPS court rejected their bail on the basis of whats app chat; the court said that the case prima facie was made against the accused.

The NCB alleged that these accused has international links and are part of the conspiracy. NCB also alleged that Aryan khan is an influential person and can temper evidence and influence witnesses.

On behalf of Aryan khan senior advocate, Mukul Rohatgi told the court that the arrest is made in violation of article 22 of the constitution as the grounds of arrest were clearly not informed to the accused. He further told the court that Aryan was not aware of the fact that Arbaaz had drugs in his possession. There is no point in conspiracy as well because there was no meeting of minds between the accused.

The advocate further said the voluntary statements made by the accused under section 67 of the NDPS act is not admissible as held by the court in the Toofan singh case.
