In M/S Prem Cottex v Uttar Haryana Bijli Vitran Nigam Ltd & others, 2021 the apex court held that due to the lack in the examination, an additional bill was raised by the power distributor doesn’t amount to deficiency in service and on such grounds the consumer complaint is not maintainable.

The issue raised before the court is that the consumer compliant due to the additional bill by power distributor is a maintainable or additional bill by power distributor will amount to deficiency in service?

The bench comprised of Justice Hemant Gupta and V Ramasubramanian heard this issue.

In this case, the complainant (consumer) filed the case before National Consumer Redressal Commission due to the additional bill given by the power company. The consumer complaint was dismissed by the National Consumer Redressal Commission on the reasoning that Power Company is just recovering its amount which left on the consumer due to the short assessment. Against this order of the National Consumer Redressal Commission consumer filed an appeal before the Supreme Court.
