The apex court held in case K Arumuga velaiah vs P R Ramasamy, 2022 that document of partition effecting partition in future is not registrable under section 17 of registration act.
The bench consists of three judges justice L Nagaeswara Rao, Justice BR Gavai and Justice BV Nagarathna observed that the document of partition is not creating any new right in immovable property it’s just giving a new document for dividing property so there is no need for registration and simply admissible in evidence.
