These days India is going towards digitalising. Day by day transaction are done online

 

These days the payments are done with the cheque are mostly all with big transaction but some of the people take granted for this. Mostly the payments which are done with the cheque are bounced; due to that, that person has to suffer from heavy loss.

 

So there are some remedies from court by which you can approach to court for help.

 

Take a legal action u/s 138 0f NI Act (criminal case)

The advocate will send a legal notice to the drawer of the cheque

Satating that a legal action will be taken against the drawer if the amount will not be paid within the prescribed period. The drawer

Has to reply the notice within 1month from the date which he received the notice. If the drawer fails to reply the notice the drawee

Has right to sue him court.

 

Benefit: The court will grant  double the amount of money which has been mentioned in the cheque and will give 2year Imprisonment to the drawer of the cheque.

 

Ordinary suit .( civil case)

It is regared as long term battle .the plantiff has In the ordinary suit you can ask court for your capital amount and the heavy interest and the loss you suffered from that.

Benefit: you will get capital amount as well as interest you prayed for.

 

Go for summary Suit.(civil case)

There is slightly difference from ordinary suit to summary suit.

This suit is speedy trial and the defendant have no option to give the

Reply to the plantiff to filed the case againt him.

Benefit: In the summary suit you can ask court for your capital amount and the heavy interest and the loss you suffered from that
