A writ petition is filed by the practising lawyer Devi Prasad Tripathy of Hon’ble High Court of Odisha for challenging the notice issued to him by the Department of GST.
In reply Principal Commissioner GST filed an affidavit in court in which he stated as ‘after receiving the information that Devi Prasad Tripathy is the practising lawyer of the Odisha High Court, the proceeding against him has ceased’.
The bench comprising Justice Muralidhar and Justice B.P Routray is concerned with the demand of evidence for proving his claim that a person is a practising lawyer in court and doesn’t come under the provision of GST or Service tax insisted by the department of GST.
Other lawyers who were present in the court said that they also received the same notices from the GST office.
The bench after hearing both sides directed the Principal Commissioner of GST to issue orders to all the officers in the GST commission rates for not sending any notices to practising lawyers for demanding GST or service tax.
