The high court of Karnataka declined the application of anticipatory bail filed before the court by K S N Rajesh, the special public prosecutor. The allegation of sexual assault and attempt to commit rape is made against him by an intern working under him in his office.

The petition is heard by the bench of single judge Justice K Natarajan, while dismissing the plea he observed that the petitioner (accused) is an influenced person in police, university and judges. He further added that in this case, it’s not appropriate to grant anticipatory bail to the petitioner.

The offences registered against him in Mangalore women police station under section 376, 376(2)(f), 376(2)(k), 376(c), 511, 354(A), 354(B), 506, 384, 388, 389 read with 34 IPC, 1860.

The court observed that after going through the complaint, it’s correctly mentioned by counsel that the offence of rape under section 376 of IPC is not committed but it’s clear from the complaint that due to the early erection petitioner was failed to commit rape. If it didn’t happen he would definitely try to have intercourse with the intern.

The court observed that the accused inappropriately touched the body of the intern by using his position over her which is an offence under sections 354 and 376 of IPC.

The court said that there are chances of tempering the evidence as the accused is influencing the person. So the court refused from granting anticipatory bail.
