In a significant development, the Supreme Court of India has intervened in a disturbing case that emerged on social media two weeks ago, where a teacher allegedly incited other students to physically assault a Muslim classmate. The Court has directed the Superintendent of Police in Muzzaffarnagar, Uttar Pradesh, to submit a detailed report detailing the progress of the investigation into this incident. Additionally, the Court has
called for information on measures taken to ensure the safety and well-being of the victim.
This pivotal decision was made by a bench comprising Justices Abhay S Oka and Pankaj Mithal in response to a writ petition filed by prominent social activist and great- grandson of Mahatma Gandhi, Tushar Gandhi. The petition, which is set to be heard on September 25, seeks not only a thorough investigation into the case but also the establishment of comprehensive guidelines for preventing and addressing violence against children within the school system, particularly those belonging to religious minorities.
According to the petitioner, the teacher involved in the incident, later identified as Tripta Tyagi, can be seen in the viral video instructing the students to strike their classmate with force, even going so far as to declare that Muslim children should “go to anyone’s area.” The video further captures her urging a student to strike harder, saying, “Why are you hitting him so lightly? Hit him hard.”
Following this disturbing incident, an FIR (First Information Report) was registered on August 26 against the school teacher under Section 323 (punishment for causing voluntary hurt) and Section 504 (intentional insult with intent to provoke a breach of peace) of the Indian Penal Code, 1860 (IPC).
However, the petitioner has alleged that since the filing of the FIR, there has been growing pressure on the victim’s family to reach a “compromise” and have the FIR against the teacher withdrawn. This has raised concerns about potential interference with the legal process and justice.
Tushar Gandhi’s petition not only seeks justice for the victim but also highlights the pressing need for a comprehensive framework to safeguard children within the
