The plaintiff, Sourav Mall, filed a class action suit seeking injunction and damages of ₹1,00,000, accusing Zomato of misleading consumers with its hot food delivery claim. According to Mall, Zomato’s scheme, which involves flying food from iconic restaurants in different cities to the consumer’s location, is not as advertised.
The crux of Mall’s argument lies in his experience with Zomato’s Dilli ke Legends service. Despite Zomato’s assurances of delivering hot and freshly prepared food, Mall claims that the food he received was cold and not in its original packaging from the restaurant partner. Instead, it arrived in Zomato-branded packaging, raising doubts about its authenticity.
Mall further alleges that the food was not even picked up from the restaurant but from a third-party location, indicating a lack of transparency in Zomato’s delivery process. He asserts that Zomato’s use of deceptive expressions like “delivered hot” and “freshly prepared” constitutes fraud, as it induces customers to place orders based on false representations.
To address these issues, Mall seeks directions for Zomato to refrain from using the expression “delivered hot” and instead use “reheated and delivered hot” to accurately reflect the process.
